Factories Corporation of Jamaica invites application from suitable qualified persons to fill the position of LEGAL OFFICER
Job Summary:
Under the general supervision of the Managing Director, the Legal Officer will be required to provide a full range of legal support and advisory services to the Corporation, to enable it to carry out its strategic mandate and business operating functions effectively and efficiently, and to ensure that the Corporation and its members of staff, in the execution of their respective functions, are fully compliant with all relevant laws, regulations, and Government and administrative requirements, policies and procedures.
The areas of focus will include but are not limited to the following:
- Units Operational Plan/Citizens Charter
- Legal Advice, opinions, briefs
- Legal Representation
- Drafting and reviewing contracts
- Cabinet Submissions
- Ministerial Briefs if needed
- Comprehensive reports
Qualification:
- An LL.B Degree
- A professional Certificate of Legal Education (CLE)
- An Attorney-at-Law licence to practice in the Courts of Jamaica.
- At least seven (7) years’ experience as a practicing Attorney in the Corporate, Business, Commercial and Conveyancing law in the private or public sector.
- A Master’s Degree would be an asset

Duties and Responsibilities:
- Management and Administrative
- Ensures that the Operational Plan is in alignment with the strategic objectives and priority programmes of the organization.
- Ensures that all priority bills on the FCJ presented in the portfolio Ministry’s Quarterly Legislation Programme are adequately represented; monitors their progress and submits update to the Managing Director and attends sittings of Parliament if necessary and provides clarification on bills as required in respect of the FCJ.
- Provides legal advice to the Managing Director and other relevant personnel on specialized and routine legal matters.
- Represents FCJ at local and international meetings, conferences and other fora as required.
- Participates in negotiations with stakeholders as required.
- Prepares and submits performance and other reports as required and ensures timely submission of all documents/information requested from the Managing Director.
- Represents the Managing Director on such committees as assigned.
- Performs such other duties and responsibilities as may be determined by the Managing Director from time to time.
- Technical/Professional Responsibilities
- Participates in negotiations and drafts or peruses employment contract, service agreement, commercial agreements, engagement and all other contracts on behalf of FCJ and ensure conformity with the related laws and policies and the interest of the organization.
- Prepares drafting instructions and/or drafting orders/directive for signature of the Managing Director, ensuring all necessary/required consultations and cabinet submissions are done and coordinates the gazetting of the orders.
- Coordinates the drafting of new policies relating to subjects and departments assigned to the organization.
- Coordinates the preparation for the filing of actions on behalf of FCJ within the purview of the Ministry and its Agencies. Seeks prosecution for offenders under the Radio and Telegraph Control Act.
- Participates in civil proceedings on behalf of the organization and/or ensuring adequate support to the Attorney General’s Department as required.
- Sits as chair committee/s established within the organization.
- Review and comments on bills emanating from other Ministries.
- Take initial instructions for Sale and Purchase of commercial property matters.
- Liaise with clients, estate agents, commercial agents, mortgage lenders and attorneys by telephone, post email or in person as necessary at every stage of the conveyance transaction.
- Manage a range of property matters from initial instructions through to matter conclusion including post-exchange work and registrations.
- Prepare lost title and splinter title applications for submission to the National Land Agency.
- Prepare documentation in relation to selling, purchasing or leasing real estate which includes the preparation of Agreements for Sale, Instruments of Transfer, Statements of Account, Letters of Possession and Utility Letters and general correspondence with Attorneys.
- Prepare applications for first registration including applications based on adverse possession.
- Prepare and submit for lodgment at the Stamp Office, assessment of duties and taxes, waiver of death duties and taxes, requests refund for duties already paid.
- Comply with requisitions received in relation to documents lodged at the Stamp Office.
- Lodge documents and liaise with the Stamp Office, National Land Agency, Registrar of Companies Office and other regulatory departments.
- Attend court to make applications to the court to determine the owners of property and for the recovery of possession.
- Make applications to the Supreme Court for the modification of restrictive covenants.
